Digital artifacts often fail to perform as expected. It has recently been argued that this should not be analyzed as software malfunctioning. Rather, every case that is not the result of hardware failures would be due to design errors. This claim, which hinges on the notion of ‘implementation’, highlights a potential fundamental difference between software and other technical artifacts. It also implies that software engineers have more extensive responsibilities than creators of other artifacts. After reconstructing the argument, we show that (...) it rests on two presuppositions regarding the nature of software and the activities of its creators, which we call ‘complete control’ and ‘self-containedness’. Software is taken to be a self-contained unit through which the software engineer exerts complete control over a machine’s behavior. These two presuppositions as well as the usage of implementation and strong claims regarding responsibility can be found throughout the literature on software engineering. Still, we argue that the presuppositions are untenable in light of current practices. For one thing, software engineers cannot exert complete control because software has become too complex for any technique to reliably locate every fault in it. For another, the creation and running of software are nowadays heavily mediated processes involving many agential activities. As a result, the performance of digital artifacts may vary, often in undesirable ways, without either hardware failures or design errors. This undermines the conclusion that software cannot malfunction, while also revealing the complications in developing a metaphysical account of software that fits contemporary practices. (shrink)

To improve oneself and grow professionally, career development has been found to be crucial, as it serves as a roadmap for the professional growth of employees. However, a barrier, known as the glass ceiling, hinders the progress of employees, especially those in the LGBTQIA+ community. This study explores the impact of the glass ceiling on the career development of selected LGBTQIA+ individuals, shedding light on the barriers faced by this community in the workplace. The researchers used a qualitative multiple-case study (...) and selected ten (10) LGBTQIA+ participants from large enterprises via the judgmental sampling technique. Through thematic analysis, psychological impact, workplace discomfort, lack of recognition, and career progress challenges emerged as the impacts of the glass ceiling on the participants. Strategies for overcoming glass ceiling barriers, such as resilience, self-reflection, and community support, are identified. Thus, the study found that glass ceilings are really evident in the context of businesses. With this, the proposed advocacy plan in the study suggests interventions like workplace inclusion training, mentorship networks, and seminars on employee rights. Furthermore, it emphasizes the call for ongoing research and advocacy efforts to dismantle barriers and cultivate workplaces that not only embrace diversity but also provide equitable opportunities for career growth. The results are interpreted in terms of a deficit in initial rule learning and subsequent generalization of these rules to new stimuli. Negative feedback is adequately processed at a neural level but this information is not used to improve behaviour on subsequent trials. As learning is degraded, the process of error detection at the moment of the actual response is diminished. Atualmente, biotecnologias são empregadas na forma de protocolos a fim de sincronizar o crescimento folicular e a ovulação, bem como permitir que vacas atuem como receptoras de embriões visando melhorar o potencial genético do rebanho. O objetivo desse estudo foi avaliar o efeito da utilização de implantes intravaginais de progesterona de 1º, 2º e 3º uso no protocolo de transferência de embriões em tempo fixo (TETF) sobre a taxa de prenhez em receptoras girolandas. O experimento ocorreu em uma fazenda localizada (...) no município de São Sebastião do Maranhão (MG). Foram utilizadas 74 vacas submetidas aos seguintes protocolos: No dia 0 (D0) administrou-se 2 ml de 17β-Estradiol e progesterona e foi colocado o implante intravaginal de progesterona. Estes implantes foram colocados de forma aleatória, sendo de 1° uso (grupo 1; n=15), 2° (grupo 2; n=24) ou 3° (grupo 3; n=35).No D8, os implantes foram retirados e administrou-se 2 ml PGF2α; 1,5 ml de eCG e 1 ml de 17β-Estradiol e progesterona. A inovulação dos embriões in vitroo correu no D (16) para todas as vacas que apresentaram um corpo lúteo. As variáveis qualitativas (prenhe ou não prenhe) foram comparadas em tabelas de contingência e analisadas pelo teste de qui-quadrado a 5% de probabilidade. Neste estudo não houve diferença estatística entre os grupos protocolados em relação ao aproveitamento como receptoras: 1º uso (53,3%), 2º (79,2%) e 3º (68,65). Ademais, observou-se uma taxa de prenhez entre os grupos de 37,5% para o 1º uso, 42,1% para o 2º e 33,3% para o 3º (P>0,05). Dentre as vantagens ao reaproveitamento dos implantes multiusos destaca-se a redução dos custos dos protocolos hormonais, já que a progesterona é o hormônio mais oneroso, desta forma, a maximização do uso reduz o valor final do protocolo sem prejuízos a taxa de prenhez. In this paper I examine Grace A. de Laguna’s theory of universals in its historical context and in relation to contemporary debates in analytic metaphysics. I explain the central features of her theory, arguing that her theory should be classified as a form of immanent realism and as a powers ontology. I then show in what ways her theory affords a theory of modality in terms of potentialities and discuss some of its consequences along the way.

There has been a call for a potentially revolutionary change to our existing understanding of the psychological concept of personal identity. Apparently, people can psychologically represent people, including themselves, as multiple individuals at the same time. Here we ask whether the intransitive judgments found in these studies truly reflect the operation of an intransitive concept of personal identity. We manipulate several factors that arbitrate between transitivity and intransitivity and find most support for transitivity: in contrast to prior work, most participants (...) do not make intransitive judgments when there is any reason to favor one individual over another. People change which single individual they personally identify with, depending on which individual competes more strongly or weakly for identity, rather than identifying with both individuals. Even when two individuals are identical and therefore both entitled to be the same person, we find that people make more transitive judgments once they understand the practical commitments of their responses (Experiment 4), and report not being able to actually imagine two perspectives simultaneously when reasoning about the scenario (Experiment 5). In short, we suggest that while people may make intransitive judgments, these do not reflect that they psychologically represent identity in an intransitive manner. (shrink)

Using semi-structured interviews and an analytic approach based on the grounded theory, this research took on constructing an understanding of the socio-emotional relevance, and the meaning that a group of elder participants of CIAM «Lucía Salas Romo» of Quilicura (Santiago, Chile) ascribe to social discourses regarding aging. Findings showed that, mobilizing the semantic dissonance between what society promotes and the effective opportunities it allows for the elderly, there are two crucial components of the social discourse: social injustice and fear of (...) dependency. In this article we aim to open a new line of debate about religion in public schools by focusing on religious ideals. We begin with an elucidation of the concept ‘religious ideals’ and an explanation of the notion of reasonable pluralism, in order to be able to explore the dangers and positive contributions of religious ideals and their pursuit on a liberal democratic society. We draw our examples of religious ideals from Christianity and Islam, because these religions have most adherents (...) in Western liberal democracies that are the focus of this article. The fifth and most important section ‘‘Reasonable pluralism and the inclusion of religious ideals in public secondary schools’’ provides three arguments for our claim that public schools should include religious ideals, namely that they are important to religious people, that they are conducive for the development of pupils into citizens of a liberal democracy, and that the flourishing of pupils as adults is advanced by encountering religious ideals. We also offer a more practical reason: religious ideals can more easily be included within public education than religious dogmas and rules. (shrink)

Full aptness is the most important concept in performance-based virtue epistemology. The structure of full aptness, in epistemology and elsewhere, is bi-levelled. At the first level, we evaluate beliefs, like performances, on the basis of whether they are successful, competent, and apt – viz., successful because competent. But the fact that aptness itself can be fragile – as it is when an apt performance could easily have been inapt – points to a higher zone of quality beyond mere aptness. To (...) break in to this zone, one must not merely perform aptly but also in doing so safeguard in skilled ways against certain risks to inaptness. But how must this be done, exactly? This paper has two central aims. First, I challenge the credentials of mainstream thinking about full-aptness by raising some new and serious problems for the view. I then propose a novel account of full aptness – what I call de minimis normativism – which keeps all the advantages of the canonical view, avoids its problems entirely, and offers some additional payoffs. David Lewis is widely known for maintaining the bizarre thesis known as genuine modal realism (hereafter, modal realism). He argued for modal realism on grounds of serviceability in On the Plurality of Worlds. However, earlier in Counterfactuals, he proposed a different kind of argument: from talk of ways things might be to possible worlds. In this paper, I examine the evolution of the latter argument in Lewis’s thought and evaluate its place in his overall case for modal realism, especially in (...) light of the alternative theory of modality known as magical ersatzism. I argue that Lewis turns the argument on its head in his critique of magical ersatzism, but that his later commitment to Ramseyan humility subjects him to a similar criticism. Therefore, the argument is, ultimately, a poisoned pawn for Lewis. (shrink)

Integrated Information Theory (IIT) is one of the most influential theories of consciousness, mainly due to its claim of mathematically formalizing consciousness in a measurable way. However, the theory, as it is formulated, does not account for contextual observations that are crucial for understanding consciousness. Here we put forth three possible difficulties for its current version, which could be interpreted as a trilemma. Either consciousness is contextual or not. If contextual, either IIT needs revisions to its axioms to include contextuality, (...) or it is inconsistent. If consciousness is not contextual, then IIT faces an empirical challenge. Therefore, we argue that IIT in its current version is inadequate. (shrink)

Internodons are a formalization of Hennig's concept of species. We present an alternative construction of internodons imposing a tree structure on the genealogical network. We prove that the segments (trivial unary trees) from this tree structure are precisely the internodons. We obtain the following spin-offs. First, the generated tree turns out to be an organismal tree of life. Second, this organismal tree is homeomorphic to the phylogenetic Hennigian species tree of life, implying the discovery of a multi-level tree of life: (...) this phylogenetic tree can be obtained by zooming out from the organismal tree, or conversely, the organismal tree of life can be generated by expanding the phylogenetic nodes into unary trees. Finally, the definition of the organismal tree allows an efficient algorithmic transformation of a given genealogical network into its corresponding phylogenetic species tree of life. This developmental study seeks to develop a Project-Based learning prototype that integrates sustainable agriculture in teaching mathematics. Data was gathered through the in-depth interviews using the developed semi-structured questionnaire. The study used the Clarke and Braun thematic analysis to analyze the data collected. The researchers found the following themes: Profitability of Aquaponics, Requisite for Computational Skills, Integration of Aquaponics in Teaching Unit Conversion, and Promoting Competencies through Self-discovery as Elements in Crafting Teaching-Learning Package for Sustainable Agriculture. Based on the result, (...) the researchers developed a Project-Based Learning Prototype that integrates Sustainable Agriculture in teaching mathematics at the grade 7 level. It has been concluded that the proposed teaching-learning prototype should promote competencies through self-discovery, that is, using real-life situations rather than hypothetical ones to engage students in meaningful projects, develop critical thinking and problem-solving skills, and prepare them for future work and careers. Further, it is recommended that future research may investigate the effectiveness and implementation of the developed teaching-learning prototype. Also, school administrators should ensure educators have access to adequate resources, training, and help to implement aquaponics education effectively. (shrink)

In identifying intrinsic molecular chance and extrinsic adaptive pressures as the only causally relevant factors in the process of evolution, the theoretical perspective of the Modern Synthesis had a major impact on the perceived tenability of an ontology of dispositional properties. However, since the late 1970s, an increasing number of evolutionary biologists have challenged the descriptive and explanatory adequacy of this “chance alone, extrinsic only” understanding of evolutionary change. Because morphological studies of homology, convergence, and teratology have revealed a space (...) of possible forms and phylogenetic trajectories that is considerably more restricted than expected, evo-devo has focused on the causal contribution of intrinsic developmental processes to the course of evolution. Evo-devo’s investigation into the developmental structure of the modality of morphology – including both the possibility and impossibility of organismal form – has led to the utilisation of a number of dispositional concepts that emphasise the tendency of the evolutionary process to change along certain routes. In this sense, and in contrast to the perspective of the Modern Synthesis, evo-devo can be described as a “science of dispositions.” This chapter discusses the recent philosophical literature on dispositional properties in evo-devo, exploring debates about both the metaphysical and epistemological aspects of the central dispositional concepts utilised in contemporary evo-devo and addressing the epistemological question of how dispositional properties challenge existing explanatory models in evolutionary biology. Principles of chance deference face two kinds of problems. In the first place, they face difficulties with a priori knowable contingencies. In the second place, they face difficulties in cases where you've lost track of the time. I provide a principle of chance deference which handles these problem cases. This principle has a surprising consequence for Adam Elga's Sleeping Beauty Puzzle.

A Teoria dos Dois Sistemas, proposta por Kahneman (2011), pressupõe que a tomada de decisão no contexto econômico se baseia em dois sistemas, um que é automático, intuitivo e principalmente inconsciente e outro reflexivo, racional e totalmente consciente. Consideramos a abordagem kahnemaniana incompleta na medida em que a concepção dos sistemas 1 e 2 não é suficiente para explicar os processos de tomada de decisão. Neste artigo, nosso desafio é mostrar que, diferentemente dos sistemas de Kahneman, a tomada de decisão (...) está ancorada na percepção direta de affordances e é a base das escolhas conceituais, que envolvem experiências sensório-motoras advindas da reciprocidade entre agente e ambiente. Concluímos este artigo, argumentando que, diferentemente da concepção de sistema 1 kahnemaniano, na perspectiva ecológica, a tomada de decisão advém de experiências não conceituais, da percepção direta, não automática, sem envolver representações mentais e processamento de informações. In this article we defend a moral conception of cosmopolitanism and its relevance for moral education. Our moral conception of cosmopolitanism presumes that persons possess an inherent dignity in the Kantian sense and therefore they should be recognised as ends‐in‐themselves. We argue that cosmopolitan ideals can inspire moral educators to awaken and cultivate in their pupils an orientation and inclination to struggle against injustice. Moral cosmopolitanism, in other words, should more explicitly inform the work that moral educators do. Real‐world constraints (...) on moral action and the need to prioritise one’s sometimes conflicting responsibilities will often qualify cosmopolitan justice as supererogatory. This fact does not absolve persons from aspiring to see themselves as having the moral obligation to help others in need, while recognising that their factual obligations are more modest in being bound by what they are actually able to do. In this paper we provide a defence of cosmopolitanism from a liberal perspective, examining its moral underpinnings, including moral obligations predicated on a belief in common humanity and the fundamental dignity of human people, cultural capacities that include an embrace of pluralism and a fallibilist disposition, and pragmatist resolve in finding humanitarian solutions to real problems that people face. We also scrutinise the ideal of cosmopolitanism by considering the ‘deeply religious’ as the sort of people about whom it may be (...) said that irreconcilable tensions exist between certain types of commitment and/or belonging and what the demands of cosmopolitanism involve. A teoria dos dois sistemas (Kahneman, 2011), em suas várias vertentes, assume que a tomada de decisão humana é baseada em dois sistemas cognitivos: um que é automático, rápido, agindo com mínimo esforço cognitivo, intuitivo (no sentido de Morewedge & Kahneman, 2010), e majoritariamente inconsciente; e outro que é reflexivo, lento, atuando com intenso esforço cognitivo, racional e totalmente consciente. Neste trabalho, investigamos a teoria dos dois sistemas e sua aplicação na tomada de decisão econômica em governos democráticos, com ênfase (...) especial na proposta de Kahneman. Consideramos sua abordagem incompleta e limitada na explicação do processo intuitivo que orienta a tomada de decisão. Essa limitação nos leva a defender a existência de um terceiro sistema de tomada de decisão em Economia: a intuição ecológica criativa, baseada no attunement entre affective drives e percepção direta de affordances, abordando não só as disposições e objetivos dos agentes, mas também a responsabilidade socioambiental das empresas e governos. Argumentamos que o terceiro sistema de tomada de decisão que propomos implica um conceito de intuição diferente do associativismo de ideias de Simon (1992), e damos como exemplo do funcionamento do terceiro sistema o processo de tomada de decisão que conduziu à formação do Banco Finapop, no Brasil. The statement intends to make research integrity challenges recognisable from the work-floor perspective, providing concrete advice on organisational measures to strengthen integrity. Transdisciplinary research knits together knowledge from diverse epistemic communities in addressing social-environmental challenges, such as biodiversity loss, climate crises, food insecurity, and public health. This paper reflects on the roles of philosophy of science in transdisciplinary research while focusing on Indigenous and other subaltern forms of knowledge. We offer a critical assessment of demarcationist approaches in philosophy of science and outline a constructive alternative of transdisciplinary philosophy of science. While a demarcationist focus obscures the complex relations between epistemic communities, transdisciplinary (...) philosophy of science provides resources for meeting epistemic and political challenges of collaborative knowledge production. Empirical work on motivated reasoning suggests that our judgments are influenced to a surprising extent by our wants, desires and preferences (Kahan 2016; Lord, Ross, and Lepper 1979; Molden and Higgins 2012; Taber and Lodge 2006). How should we evaluate the epistemic status of beliefs formed through motivated reasoning? For example, are such beliefs epistemically justified? Are they candidates for knowledge? In liberal democracies, these questions are increasingly controversial as well as politically timely (Beebe et al. 2018; Lynch forthcoming, 2018; (...) Slothuus and de Vreese 2010). And yet, the epistemological significance of motivated reasoning has been almost entirely ignored by those working in mainstream epistemology. We aim to rectify this oversight. Using politically motivated reasoning as a case study, we show how motivated reasoning gives rise to three distinct kinds of skeptical challenges. We conclude by showing how the skeptical import of motivated reasoning has some important ramifications for how we should think about the demands of intellectual humility. (shrink)

According to the Principle of Alternative Possibilities, an agent is morally responsible for an action of hers only if she could have done otherwise. The notion of a robust alternative plays a prominent role in recent attacks on PAP based on so-called Frankfurt cases. In this paper I defend the truth of PAP for blameworthy actions against Frankfurt cases recently proposed by Derk Pereboom and David Widerker. My defence rests on some intuitively plausible principles that yield a new understanding of (...) the concept of a robust alternative. I will leave aside whether PAP also holds for praiseworthy actions -/- Según el Principio de Posibilidades Alternativas, un agente es moralmente responsable de una acción sólo si hubiera podido actuar de otro modo. La noción de alternativa robusta desempeña un papel prominente en ataques recientes al PPA basados en los llamados casos Frankfurt. En este artículo defiendo el PPA para la culpabilidad moral frente a casos Frankfurt propuestos recientemente por Derk Pereboom y David Widerker. Mi defensa descansa en algunos principios intuitivamente plausibles que dan lugar a una comprensión nueva del concepto de alternativa robusta. Neste artigo, nós buscamos compreender como a disseminação de fake news, através do uso de tecnologias digitais, tornou-se uma ferramenta poderosa na manipulação da opinião pública, contribuindo para o processo de colonialidade de mentes. A colonialidade de mentes, contextualizada nos estudos de Dascal (2009), é um tipo de violência epistêmica, caracterizada como transmissão e modificação de hábitos através de sistemas sociais como família, linguagem, religião, ciência, educação, ideologia e mídia que disseminam as formas de imposição do pensamento e ação do (...) colonializador. Nossa hipótese é a de que o paradigma da complexidade, fundamentado no pensamento de Morin (2003; 2005), oferece subsídios teóricos para pensarmos o problema da disseminação de fake news, bem como a sua influência na colonialidade de mentes na medida em que expressa uma visão de mundo não fragmentada e sistêmica, pautada por princípios como o hologramático e o dialógico. Com base nestes princípios, nosso principal foco será oferecer um caminho para pensarmos sobre a colonialidade de mentes através da ética da complexidade. (shrink)

This study brings light to the concepts of State and Government in the thought of Marsilio de Padua pointing out to profoundly modern institutions present in the reflection of this medieval philosopher. We attempt to show that Marsilio de Padua reflects based on Aristotle´s categories, but proposes a State and Government conception different from that common place of medieval politics as he insists on the need of the popular consent as a criterion of political legitimacy. -/- O estudo explicita os (...) conceitos de Estado e de Governo no pensamento de Marsílio de Pádua apontando as intuições profundamente modernas presentes na reflexão desse filósofo medieval. Procuramos mostrar que Marsílio reflete com categorias aristotélicas, mas propõe uma concepção de Estado e de Governo que se distancia do lugar comum da reflexão política medieval ao insistir na necessidade do consentimento dos súditos como critério de legitimidade política. Spinoza, le spinozisme et les fondements de la sécularisation est un ouvrage dédié à la mémoire d’Emmanuel Levinas, dont l’auteur a été l’élève durant plusieurs années. Il vise, à travers une analyse d’ordre philosophique, historique, épistémologique et théologique, à mettre au jour les conditions d’émergence interrelatées du spinozisme et de la sécularisation. Pour ce faire, il souligne, entre autres, l’importance des polémiques anti-maimonidiennes, des débats sur les attributs divins, la substance, l’infini, du marranisme et de la Kabbale sur la formation (...) du spinozisme, ainsi que son rapport à la pensée contemporaine. Il mène une recherche interdisciplinaire devant permettre d’éclairer l’origine des difficultés théoriques que ce système philosophique présente. (shrink)

El presente artículo se circunscribe en el área de historia del pensamiento y filosofía de la ciencia. La pesquisa comprende un análisis de la transición que se gesta en el díalogo Brahe-Kepler y la superación del modelo cosmológico; se comprende la oposición del modelo geocéntrico respecto al heliocéntrico como parte del contexto y se ultima con la exposición de las tres leyes keplerianas producto de la superación del sistema tychonico.

La question des rapports du spinozisme à l’axiologie a fait l’objet de nombreux débats. Certains commentateurs considèrent Spinoza comme étant profondément immoraliste, alors que pour d’autres, il maintient l'ensemble des valeurs humaines. Spinoza a cherché à dépasser l’utilitarisme propre au conatus de chacun, afin de fonder un altruisme rationnel. Il souligne que le bien auquel l’homme aspire lorsqu’il suit la vertu, il le désirera aussi pour tous les autres hommes. Cependant, les moyens mis en œuvre pour démontrer cette thèse semblent (...) problématiques. Cet article analyse la logique de la coopération interhumaine élaborée par Spinoza, ainsi que son idéal de l’homme libre, montrant, qu'en fait, il n'a pas réussi à surmonter la nature profondément égoïste du conatus. -/- The question of the relationship between Spinozism and axiology has been the subject of much debate. Some commentators consider Spinoza to be profoundly immoralist, while for others he upholds the set of human values. Spinoza sought to go beyond the utilitarianism proper to the conatus of each person, in order to establish a rational altruism. He emphasizes that the good to which man aspires when he follows virtue, he will also desire for all other men. However, the means used to demonstrate this thesis seem problematic. This article analyzes Spinoza's logic of interhuman cooperation, as well as his ideal of the free man, showing that, in fact, he failed to overcome the profoundly egoistic nature of conatus. -/- . “¿Principio de caridad o hybris?” La intuición de Wittgenstein, de que el significado lingüístico se constituye dentro de la trama de vida pareciera hacer posible un acercamiento entre la tradición hermenéutica continental y la filosofía analítica del lenguaje. En el presente artículo se sostiene que esta intuición debe ir acompañada de una revisión de la concepción del sujeto implícita en el “principio de caridad” de Donald Davidson. Sin esa reconcepción, el principio de caridad se convierte en una forma encubierta de (...) imperialismo conceptual incompatible con el espíritu de la hermenéutica continental. Se concluye el artículo con algunas observaciones sobre el relativismo a la luz de las consideraciones anteriores. (shrink)

Kit Fine has proposed a new solution to what he calls ‘a familiar puzzle’ concerning modality and existence. The puzzle concerns the argument from the alleged truths ‘It is necessary that Socrates is a man’ and ‘It is possible that Socrates does not exist’ to the apparent falsehood ‘It is possible that Socrates is a man and does not exist’. We discuss in detail Fine’s setting up of the ‘puzzle’ and his rejection, with which we concur, of two mooted solutions (...) to it. (One of these uses standard, Kripkean, notions, and the other rests on work done by Arthur Prior.) We set out, and reject, the philosophy of modality underlying Fine’s new solution, and we defend an alternative response to the alleged puzzle. Our solution follows the work of David Wiggins in distinguishing between the sentential operator ‘It is necessary that’ and the predicate modifier ‘necessarily’. We briefly provide this distinction with a possible- world semantics on which it is neither a necessary truth, in some sense, that Socrates exists nor true, in some sense, that Socrates necessarily exists. This paper examines three accounts of the sleeping beauty case: an account proposed by Adam Elga, an account proposed by David Lewis, and a third account defended in this paper. It provides two reasons for preferring the third account. First, this account does a good job of capturing the temporal continuity of our beliefs, while the accounts favored by Elga and Lewis do not. Second, Elga’s and Lewis’ treatments of the sleeping beauty case lead to highly counterintuitive consequences. The proposed (...) account also leads to counterintuitive consequences, but they’re not as bad as those of Elga’s account, and no worse than those of Lewis’ account. (shrink)

This paper argues, based on Lewis’ claim that communication is a coordination game (Lewis in Minnesota studies in the philosophy of science, University of Minnesota Press, Minneapolis, pp 3–35, 1975), that we can account for the communicative function of demonstratives without assuming that they semantically refer. The appeal of such a game theoretical version of the case for non-referentialism is that the communicative role of demonstratives can be accounted for without entering the cul de sac of trying to construct conventions (...) of ever-increasing complexity. Instead communication via demonstratives is explained with reference to the general, non-domain specific ability of human beings to solve games of coordination. Furthermore, there is empirical support for such a view. Judgments concerning demonstrative reference have been shown to be sensitive to judgments concerning common ground (Clark et al. in J Verb Learn Verb Behav 22:245–258, 1983), which is exactly what the non-referentialist account would predict. The game theoretical account also allows for an intuitively plausible, non-referentialist treatment of Speaks’ ‘trumping argument’ (Speaks in Philos Stud 174:709–734, 2017), as well as the Carnap/Agnew puzzle (Kaplan in Syntax Semant 9:221–43, 1970). For the past half-century, both jurisprudence and epistemology have been haunted by questions about why individual evidence (i.e., evidence which picks out a specific individual) can sufficiently justify a guilty or liable verdict while bare statistical evidence (i.e., statistical evidence which does not pick out a specific individual) does not sufficiently justify such a verdict. This thesis examines three popular justifications for such a disparity in verdicts – Judith Jarvis Thomson’s causal account, Enoch et al.’s sensitivity account, and Sarah Moss’ (...) knowledge-first account, before critiquing each in turn. After such an analysis, the thesis then defends the claim that legal verdicts require the factfinder (e.g., the judge or jury) to have a justified de re belief (i.e., a belief about a specific object – namely the defendant), and that this doxastic requirement justifies the disparity in rulings, as it is epistemically insufficient to justify a de re belief based on bare statistical evidence alone. A brief account of how these beliefs are formed and spread is also given. After making such a distinction, the thesis then formalizes the burdens of proof of the preponderance of the evidence and beyond a reasonable doubt using the de re/de dicto distinction. Finally, the thesis pre-empts possible objections, namely by providing an account of DNA evidence as individual evidence and giving an account of how false convictions can occur on the de re view of legal proof. In this essay, I give an analysis of the account of non-being in the Weltalter, focusing on the ways in which this account reflects Schelling’s new ontology of revelation. I begin by discussing the connection between non-being and the fundamental distinction between the principles in God. I then turn to the relationship of non-being to being in the Weltalter and show how a new meaning of being allows Schelling to distinguish non-being from nothing. The new meaning of being also makes (...) possible a distinction between essential non-being and de facto non-being; this distinction allows for the temporal sequence of revelation and the possibility of evil. I conclude by showing the implications of Schelling’s theory of non-being for his understanding of creation. (shrink)
